Eligibility determinations

We support the procurement needs of eligible federal and tribal governments and organizations, state, local, and territorial governments, and other eligible non-governmental organizations. We refer to these governments and organizations as entities.

Our office evaluates entities to confirm their eligibility to buy through GSA (see section 4 for what our office does not cover). The evaluation process is called eligibility determination. Eligible entities can buy goods, services, and solutions, subject to applicable conditions, from GSA sources.

Generally, entities that fall under the umbrella of an eligible parent entity are eligible, even if they are not specifically identified. For example, if you see a city government is listed, that generally means all offices and departments that are part of the city government are eligible.

If you are unable to find the entity you are looking for (e.g., your entity or the parent entity), you can submit a request for an eligibility determination by following the instructions in section II.

2. Request an eligibility determination or seek assistance

You can request an eligibility determination or seek assistance by emailing [e-mail]. When submitting a request for an eligibility determination, include the following information:

1. The entity type that best describes your organization:
   1. U.S. federal government
   2. U.S. state and local government
   3. Tribe or tribal organization
   4. Non-governmental organization
2. If known, the GSA source(s) you are interested in using. (Example, GSA’s Multiple Award Schedule)
3. Supporting documentation, such as a copy of recent Financial Statements or Articles of Incorporation, etc.
4. A point of contact and their contact information.

3. Conditions

Eligible entities must comply with the following conditions that apply to all entity types. Conditions that are specific to an entity type are listed on the applicable entity sub-pages.

• Eligibility does not guarantee that a product, service, or solution is/will be available under the GSA source you want to use or available from the contractor.
• An entity’s eligibility cannot be transferred to a third party, such as a contractor and subcontractor.
• Eligibility does not include purchases for resale, unless specifically authorized.
• You must comply with all requirements established by the GSA program and GSA source that you intend to use. Refer to the specific GSA program/source for specific requirements (e.g., who may use and how to place orders).
• You must comply with all requirements established by the underlying authority that support your eligibility. For example, if you are using Native American Housing Assistance and Self Determination Act funds, you need to also comply with the grant-making agency requirements on the use of those funds.

4. Other sources

Our eligibility process does not support the following:

• The use of government sources by contractors (and subcontractors) under the authority of FAR part 51. For information about this authority, contact the contracting officer that administers your federal contract.
• The ability to obtain federal surplus property.
• The purchase of items available under the Wildland Fire Protection program. For information about this program, contact the Defense Logistics Agency at [e-mail] or 1-877-DLA-CALL (352-2255).
• The purchase of items available under the U.S. Department of Defense 1122 program. If you wish to use the 1122 Program, contact your state designated 1122 program representative.
• Use of the GSA Fleet Leasing program. The Office of Fleet Management makes eligibility determinations to use the GSA Fleet Leasing program.
